Terms of Service

Effective Date: April 18, 2026

These Terms of Service ("Terms") govern your access to and use of the PinLaunchr website located at http://pinlaunchr.com (the "Site") and the software, applications, tools, and services offered by PinLaunchr ("PinLaunchr," "we," "us," or "our"), including AI-powered Pinterest pin generation, title and description generation, content scheduling, board management, performance analytics, and workflow automation (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By clicking "Sign up," creating an account, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, Refund Policy, Acceptable Use Policy, AI Usage & Generated Content Policy, and DMCA / Copyright Policy, each of which is incorporated into these Terms by reference.

If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. You must also comply with Pinterest's own minimum age and account requirements when connecting a Pinterest account.

3. Your Account

  • You must provide accurate, current, and complete information when registering and keep it up to date.
  • You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at help@pinlaunchr.com if you suspect unauthorized access to your account.
  • You may not share, sell, or transfer your account, or use another person's account without permission.
  • We may suspend or terminate accounts that violate these Terms (see Section 13).

4. The Service

PinLaunchr provides tools that allow you to:

  • Generate Pinterest pin images using artificial intelligence;
  • Generate Pinterest titles and descriptions using artificial intelligence;
  • Schedule Pinterest content and export bulk-upload files;
  • Manage Pinterest boards;
  • Analyze Pinterest performance; and
  • Automate Pinterest marketing workflows, including uploading images and content for Pinterest publishing.

We may add, modify, or discontinue features at any time. We will use reasonable efforts to notify you of material changes that adversely affect paid functionality.

5. Pinterest Integration

  • PinLaunchr is an independent product. PinLaunchr is not affiliated with, endorsed by, sponsored by, or certified by Pinterest, Inc. "Pinterest" is a trademark of Pinterest, Inc.
  • Certain features require you to connect your Pinterest account via Pinterest's official API and OAuth authorization flow. By connecting your Pinterest account, you authorize PinLaunchr to access and act on your Pinterest data (e.g., boards, pins, analytics) solely to provide the Service, consistent with the permissions you grant.
  • Your use of Pinterest remains subject to Pinterest's own Terms of Service, Community Guidelines, and Developer Policies. You are responsible for ensuring your use of the Service complies with Pinterest's rules. We are not responsible for actions Pinterest takes against your Pinterest account.
  • You may disconnect your Pinterest account at any time from your account settings or via Pinterest's connected-apps settings.
  • Pinterest may change or restrict its API at any time, which may affect Service functionality. We are not liable for Service interruptions caused by changes to the Pinterest platform.

6. AI-Generated Content

The Service uses third-party artificial intelligence models to generate images, titles, descriptions, and other content ("Generated Content"). Your use of Generated Content is governed by these Terms and our AI Usage & Generated Content Policy. In summary:

  • No guarantee of accuracy or uniqueness. AI output may be inaccurate, incomplete, or similar to content generated for other users. You must review all Generated Content before publishing it.
  • You are responsible for Generated Content you publish. You must ensure it complies with applicable law, Pinterest's policies, and third-party rights before use.
  • Ownership. As between you and PinLaunchr, and to the extent permitted by law and our AI providers' terms, you own the Generated Content you create through the Service, subject to the licenses in Section 9.
  • We make no representation that Generated Content is protectable by copyright or that it does not infringe third-party rights.

7. Subscriptions, Credits, and Billing

7.1 Plans and Credits

  • The Service is offered on a free plan and paid subscription plans (e.g., Starter, Pro), each with a monthly credit allowance used to pay for AI generations and related actions.
  • Credit costs per action (e.g., per image generation, per text generation) are displayed in the Service and may change prospectively.
  • Unused plan credits may roll over as described in the Service. One-time credit packs ("top-ups") may also be available.
  • Credits have no cash value, are non-transferable, and may not be resold.

7.2 Billing

  • Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor (Stripe). By subscribing, you authorize recurring charges to your payment method.
  • Prices are stated in U.S. dollars and exclude applicable taxes, which you are responsible for.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time from your account billing settings.
  • If a payment fails, we may retry the charge and/or suspend paid features until payment succeeds.

7.3 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at your next renewal. If you do not agree to a price change, you may cancel before it takes effect.

8. Refunds and Cancellations

Cancellations stop future renewals; they do not retroactively refund the current period except as described in our Refund Policy, which is incorporated into these Terms. Credits consumed by completed AI generations are non-refundable. Statutory refund rights, where applicable, are not affected.

9. User Content and Licenses

9.1 Your Content

"User Content" means content you upload to or create within the Service, including images, URLs, article text, prompts, titles, descriptions, and board data. You retain all ownership rights in your User Content.

9.2 License to Us

You grant PinLaunchr a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, transmit, and display User Content solely as needed to operate, provide, secure, and improve the Service (including transmitting prompts and inputs to AI providers and publishing content to Pinterest at your direction). This license ends when you delete the content or your account, except where retention is required by law or the content has already been published to third-party platforms at your direction.

9.3 Your Responsibilities

You represent and warrant that you own or have all necessary rights to your User Content, and that your User Content and your use of the Service do not violate any law or infringe any third-party right, including copyright, trademark, privacy, and publicity rights.

10. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks (excluding User Content and Generated Content), is owned by PinLaunchr or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except as permitted by law.

Feedback you provide may be used by us without restriction or obligation to you.

11. Acceptable Use

You must comply with our Acceptable Use Policy. Prohibited activities include, without limitation: spam or platform manipulation; infringing, deceptive, hateful, or unlawful content; circumventing usage limits or credit metering; scraping or abusing the Service or APIs; interfering with the Service's operation; and using the Service to violate Pinterest's policies.

12. Third-Party Services

The Service relies on third-party providers, including payment processing (Stripe), authentication (Google Firebase), cloud hosting and storage (e.g., Supabase), AI model providers (e.g., OpenAI and other image/text model providers), optional third-party image hosts you select (e.g., ImgBB, Postimages, ImgHippo), and the Pinterest API. Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for third-party services.

13. Termination

  • By you. You may stop using the Service and/or delete your account at any time from your account settings.
  • By us. We may suspend or terminate your access (with or without notice) if you breach these Terms, create risk or legal exposure for us, fail to pay amounts due, or where required by law. Where practicable, we will provide notice and an opportunity to cure non-material breaches.
  • Effect. Upon termination, your license to use the Service ends. Sections that by their nature should survive (including Sections 6, 9.3, 10, and 14–17) survive termination. We may delete your data following termination in accordance with our Privacy Policy and data retention practices.

14. Disclaimers of Warranties

THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT ANY PARTICULAR RESULTS FROM USE OF THE SERVICE, INCLUDING ANY LEVEL OF PINTEREST TRAFFIC, ENGAGEMENT, RANKING, OR REVENUE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. SEE ALSO OUR DISCLAIMER.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT WILL PINLAUNCHR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PINLAUNCHR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Indemnification

You will defend, indemnify, and hold harmless PinLaunchr and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use or publication of Generated Content; (c) your violation of these Terms or applicable law; (d) your violation of Pinterest's terms or policies; or (e) your infringement of any third-party right.

17. Governing Law and Dispute Resolution

  • Governing law. These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-laws principles.
  • Informal resolution first. Before filing a claim, you agree to contact us at contact@pinlaunchr.com and attempt in good faith to resolve the dispute informally for at least 30 days.
  • Binding arbitration. Except for small-claims matters and claims for injunctive relief relating to intellectual property or unauthorized access, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Albuquerque, New Mexico, or remotely by videoconference. Judgment on the award may be entered in any court of competent jurisdiction.
  • Class action waiver. DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. YOU AND PINLAUNCHR WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
  • Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing contact@pinlaunchr.com with the subject "Arbitration Opt-Out" and your account email.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by email or in-product notice) at least 14 days before the changes take effect, except where changes are required by law or relate to new features. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. General Provisions

  • Entire agreement. These Terms (with the incorporated policies) are the entire agreement between you and PinLaunchr regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Export and sanctions. You may not use the Service in violation of U.S. export controls or sanctions.
